PIAB, now formally known as the Injuries Resolution Board, is the independent statutory body that assesses compensation for personal injury claims in Ireland. It was established under the Personal Injuries Assessment Board Act 2003. Most personal injury claims must go through PIAB before either party can bring the matter to court.
See a doctor as soon as possible after your accident, even if your injuries seem minor, and report the incident to the relevant party.
Under Section 8 of the Civil Liability and Courts Act 2004, a letter of claim should be sent within two months of the accident, where practicable.
Your solicitor lodges Form A with PIAB, along with a medical report and details of financial losses. The respondent then has 90 days to consent to an assessment.
PIAB has nine months to assess your claim, based on the Personal Injuries Guidelines. You are not obliged to accept the assessment.
If either side rejects the assessment, PIAB authorises court proceedings in the appropriate court based on claim value.
